1. COMPANY AND PURPOSE

The service is provided by Vértika SpA, RUT [COMPLETAR RUT], address [COMPLETAR DOMICILIO], registered with SERNATUR under N° 107395 ("Vértika" or "the Company"). Contact: WhatsApp +56 9 4694 6601 and email vertikaclimbing@gmail.com.

This document sets the conditions for bookings, payments, date changes, cancellations, refunds, late arrivals, no-shows and suspensions of the rock climbing activities offered by the Company.

You receive these terms before you pay. They are always available at vertika.cl/terms.html, where you can save or print them.

2. THE SERVICE

A full-day guided sport climbing trip on real rock in Cajón del Maipo, Santiago Metropolitan Region. It is designed for people with no climbing experience.

DurationFull day. Approximate schedule: meeting at 8:00 am and return around 5:00 pm.
DifficultyBeginner. No climbing experience needed. Includes a short hike on a mountain trail to reach the rock.
Meeting pointConfirmed when you book (usually Plaza Egaña, Santiago).
IncludedRound-trip transport from the meeting point; certified guide, with a maximum of 5 people per guide; safety briefing; helmet, harness and climbing shoes for each person; rope equipment (ropes, quickdraws and belay devices), set up and managed by the guide; accident insurance; first aid kit; snack and packed lunch.
Not includedTransport to the meeting point, extra food, personal gear or clothing, and any service not listed as included.
What to bringComfortable clothes, a jacket or fleece, water (at least 1.5 litres), sunscreen, a hat, sunglasses and a small backpack. Hiking boots are ideal but not required.

Times are approximate and can change because of the conditions of the day and the safety of the group.

3. REQUIREMENTS AND RESTRICTIONS

  • Age: the activity is for people from 16 to 70 years old.
  • Under 18: you need written permission signed by a parent or legal guardian. They also sign the registration and risk acceptance form.
  • Fitness: you need a basic level of fitness to walk on mountain trails and do moderate physical effort.
  • Restrictions: if you are pregnant, have a recent injury or a health condition that physical effort or altitude can make worse, tell us before you book. We may ask for a medical authorization or tell you the activity is not suitable for you. If we tell you before you pay, you pay nothing. If we find out after you pay, we refund 100%, unless you did not tell us or gave false information.
  • Registration and risk acceptance form: before the activity, each person completes and signs this form. It includes an emergency contact, a health declaration and your informed acceptance of the risks of rock climbing. It is available in Spanish and English.

If a person hides or gives false information that affects their safety or the group's safety, the Company can stop them from taking part. In that case, the no-show rules in point 9 apply.

4. PRICE, BOOKING AND PAYMENT

  • Price: before you book, we tell you the final price per person, in Chilean pesos, with all taxes included. There are no extra charges for the services listed as included.
  • Deposit: to confirm your booking, you pay a 50% deposit. This reserves the date, your spot, the guide and the other resources.
  • Balance: you pay the other 50% up to 48 hours before the activity. If you do not pay on time, we will contact you. If the payment is not made, we may release your spot and point 6.2 applies.
  • Payment methods: bank transfer or the online payment methods we give you when you book. We issue the legal tax document for every payment.
  • Confirmation: after we receive your deposit, we send you a written confirmation by WhatsApp or email. It includes the activity, date, meeting point and time, total price, amount paid and balance, plus a link to these terms.

5. RIGHT OF WITHDRAWAL

What is it? Chilean consumer law (Law N° 19.496) gives people who buy online or at a distance the right to change their mind within 10 days, without giving a reason, and get their money back. This is called derecho a retracto (right of withdrawal). For services, the same law allows the provider to exclude this right, if it says so clearly before the purchase.

Vértika SpA informs you that the RIGHT OF WITHDRAWAL (DERECHO A RETRACTO) DOES NOT APPLY to its services, including services booked online or at a distance, according to article 3 bis, letter b), of Law N° 19.496.

Instead, you can cancel your booking under point 6, which gives you a 100% refund if you cancel 72 hours or more before the activity.

6. CANCELLATION BY THE CLIENT

6.1. 72 hours or more before

You get a refund of 100% of the amount you paid.

6.2. Less than 72 hours before

You get a refund of 25% of the total price of the activity. This is calculated on the total booking price, not on what you have paid so far. For example, if you paid only the 50% deposit, we refund 25% of the total price. If you paid 100%, we also refund 25% of the total price. In both cases, you do not have to pay any remaining balance.

The part we keep covers costs already committed for the trip (transport, guide, food and your reserved spot) that we cannot recover with short notice.

6.3. Refund time and method

We make refunds within 10 business days after the cancellation, with no extra charges, using the same payment method when possible, or by bank transfer to the account you tell us.

7. HOW TO CANCEL

Please cancel in writing through our official channels:

To count the time limits, we use the date and time the message was sent, as shown by the channel itself. We will confirm in writing that we received your cancellation and the amount to be refunded.

8. DATE CHANGE REQUESTED BY THE CLIENT

  • If you ask to change the date 72 hours or more before the activity, the change is free, depending on available spots and guides. If no date works for you, you can cancel under point 6.1.
  • If you ask less than 72 hours before, we will check our availability. If a change is not possible, point 6.2 applies.
  • If the new date has a different price or conditions, we will tell you before confirming, and you can say no.
  • Once the new date is confirmed, these same terms apply to that date.

9. LATE ARRIVAL AND NO-SHOW

Because of the type of activity, schedules and logistics are part of the group's safety. Please be at the confirmed place and time.

9.1. More than 20 minutes late

If you arrive more than 20 minutes after the confirmed time, the group may leave without you. This counts as a no-show and there is no refund.

9.2. No-show

If you do not come to the confirmed place and time, and you did not cancel before, there is no refund.

In both cases, we may look at exceptional situations and, if availability and safety allow it, offer an alternative.

10. SUSPENSION FOR SAFETY, WEATHER OR FORCE MAJEURE

The Company can suspend, change or reschedule an activity, before or during the trip, when the guide in charge or the Company reasonably believes that conditions put the safety of participants or staff at risk. For example:

  • Bad weather: rain, snow, ice, wind or extreme temperatures.
  • Terrain or rock conditions, such as rockfall or other natural risks.
  • Closure or restricted access to the area, or orders from the authorities.
  • Forest fires, earthquakes, floods, landslides, emergencies or accidents in the area.
  • Any other unexpected and unavoidable event (force majeure) that makes the activity unsafe.

10.1. Suspension before the activity starts

We will tell you as soon as possible, and you choose:

  • a new date at no extra cost, depending on availability; or
  • a 100% refund of what you paid, within the time in point 6.3.

10.2. Suspension after the activity starts

If we must stop an activity that has already started, the guide in charge decides. Stopping an activity to protect people is not a breach of service. In this case, we will offer you a new date to complete the part you missed, for free. If none of the available dates works for you, we will refund the part of the price for the service not provided.

11. CANCELLATION BY THE COMPANY

If we cannot run a trip for our own reasons, such as no guide available, a transport problem or not reaching the minimum number of participants given when you booked, we will tell you as early as possible. For the minimum number of participants, we will tell you at least 48 hours before. You choose a new date for free or a 100% refund, within the time in point 6.3.

This does not limit any other rights you have under the law.

12. SAFETY AND BEHAVIOUR DURING THE ACTIVITY

  • Before climbing, the guide gives a safety briefing. Always follow the guide's instructions and use the safety equipment provided.
  • You cannot take part under the effects of alcohol, drugs or medicines that affect your reactions.
  • The guide can limit or stop the participation of a person whose condition or behaviour puts themselves or the group at risk, after a warning, unless the risk is immediate. In these cases there is no refund.
  • Respect nature and the Leave No Trace principles: take your trash with you, do not damage plants or animals, and follow the rules of the area.

13. INSURANCE AND EQUIPMENT

Each participant has accident insurance during the activity, according to the coverage and conditions of the Company's policy. You can ask for the coverage details before the trip.

The Company provides safety equipment in good condition, checked before each trip. The equipment belongs to the Company. Use it as the guide says and return it at the end of the day.

The Company is not responsible for the loss of or damage to personal items that were not given to its care.

14. PHOTOS

We take photos during the activity and share them with participants as a souvenir. Vértika will only post photos where you can be recognised on its website or social media if you give clear permission. You can take back your permission at any time by writing to us, and we will remove the photos.

15. PERSONAL DATA

  • Data controller: Vértika SpA, contact vertikaclimbing@gmail.com.
  • Data we use: name, RUT or passport, date of birth, contact details, emergency contact, shoe size and the health information you give in the registration form.
  • Why: to manage your booking, arrange and use the accident insurance, issue tax documents, provide a safe service and follow adventure tourism rules. Health information is sensitive data: we ask for it with your clear consent and only use it for your safety during the activity.
  • Who we share it with: only the insurance company, the guide in charge of the trip, or the authorities when the law requires it. We never sell your data or share it for marketing.
  • How long: only as long as we need it for the service and as required by tax and adventure tourism rules. Then we delete it.
  • Your rights: you can ask to access, correct, delete, move or block your data, or object to its use, by writing to vertikaclimbing@gmail.com. We will answer within the legal time limits. You can also contact Chile's Personal Data Protection Agency (Agencia de Protección de Datos Personales).
  • This website does not use forms or tracking cookies.

16. CHANGES TO THESE TERMS

The Company may update these terms and will show the date of each new version. Changes only apply to bookings made after they are published. Each booking follows the version in force when you paid the deposit.

17. ACCEPTANCE, LAW AND COMPLAINTS

Before you pay and confirm a booking, you can read, save or print these terms. Paying the deposit means you accept them. This does not remove any consumer rights that the law says cannot be waived.

These terms follow the laws of Chile, especially Law N° 19.496 on Consumer Protection and the rules for adventure tourism services. If you have a problem, please write to us first so we can find a solution. You can always make a complaint to SERNAC (Chile's National Consumer Service) or SERNATUR (National Tourism Service).
